Individual entrepreneur Shabelnyk Larysa Volodymyrivna, Tax ID: 2554418067 (hereinafter - "Lessor"), provides to a person (hereinafter - "Lessee") premises and adjacent territory for personal use by the Lessee. The terms of use are defined in this Public Offer (hereinafter - "Offer").
1.1. Under this Offer, the Lessor transfers, and the Lessee accepts for temporary paid use, premises (hereinafter - "Dome"), as well as adjacent territory (hereinafter - "Terrace"), located on the roof of the building at: Kyiv, Bakynska str., 37D (hereinafter - "Location").
1.2. The Location includes: Dome with an area of 40 m²; Terrace with an area of 120 m²; items located in the Dome and on the Terrace intended for use by the Lessee (the list of such items depends on the option chosen by the Lessee for using the Location, as defined on the website https://cloudrooftop.com).
1.3. Transfer of the Location for rent does not result in the Lessee acquiring ownership rights to the Location. The Lessor remains the owner of the Location, and the Lessee uses it during the rental period.
1.4. The parties have agreed that relations between the Lessor and Lessee are governed exclusively by this Offer. For situations not regulated by the Offer, the legislation of Ukraine in force at the time of such situations applies.
2.1. The Lessor transfers the Location for rent for personal use by the Lessee. The Lessee is prohibited from subletting the Location to any third parties.
2.2. The Lessee can choose one of the following Location usage options: "Morning Date"; "Face-to-face"; "Sky for Two"; "Perfect Proposal"; "Rooftop Movie Date"; "Sky Bath". Current terms for each of the above options are defined on the website https://cloudrooftop.com.
2.3. Images of the Location shown on the website https://cloudrooftop.com and/or Lessor's social networks are solely illustrations of the Location at a certain time of year and day, under certain weather conditions and from a certain angle. The Lessee may not make claims regarding the discrepancy between the actual appearance of the Location compared to its images on various Lessor's resources on the Internet.
2.4.1. treat all property that is part of the Location with care, prevent its damage and deterioration;
2.4.2. comply with fire safety rules, as well as rules for using water supply, thermal and electrical energy;
2.4.3. it is strictly prohibited to independently light the fireplace and candles in the Dome;
2.4.4. not perform actions that may lead to any damage or deterioration of the building on the roof of which the Location is situated;
2.4.5. upon the end of the rental period, notify the Lessor of any damage and/or deterioration of property caused by the Lessee during their stay at the Location;
2.4.6. immediately notify the Lessor of any malfunctions at the Location that make the use of any part of the Location impossible and/or may cause harm to the life and health of persons and/or damage property at the Location (electrical, water supply, heating malfunctions; malfunctions caused by natural phenomena, etc.);
2.4.7. in cases provided for in the preceding paragraph, provide uninterrupted access to the Lessor for inspection of the Location and implementation of measures related to the elimination of such malfunctions;
2.4.8. not use the Location for purposes related to any illegal activity by any person;
2.4.9. all service packages are designed for two people; for additional guests the Lessee must pay an additional 1,000 UAH per person, regardless of the time spent at the Location by third parties;
2.4.10. not bring animals (all representatives of the animal world) to the Location;
2.4.11. provide truthful information about their age and the age of persons visiting the Location with the Lessee. Only persons who have reached 18 years of age are allowed at the Location;
2.4.12. observe quiet hours from 22:00 to 08:00;
2.4.13. not consume food and/or beverages that may stain any surfaces (red wine, dark juices, carbonated drinks, etc.). Only the following products may be consumed at the Location: sushi, cheeses, desserts, fruits. Beverages: white wine, white champagne, and light juices;
2.4.14. not consume any strong alcoholic beverages at the Location (containing 35 or more volume percent of alcohol);
2.4.15. not consume food with strong odors (smoked items, meat, seafood, etc.);
2.4.16. not consume tobacco products and/or use any electronic smoking devices in the Dome. Smoking is permitted exclusively in the designated area, of which the Lessor informs the Lessee;
2.4.17. not bring to the Location items that are seized or restricted in civilian circulation (firearms, gas or cold weapons; explosive, toxic objects and substances, etc.);
2.4.18. not bring any pyrotechnics to the Location (poppers, fireworks, smoke bombs, confetti, etc.);
2.4.19. not use narcotic drugs and psychotropic substances;
2.4.20. the Lessor undertakes not to be present at the Location during the Lessee's stay within the time period provided for in the Appendix, except for cases provided for in clause 2.4.5 of the Offer;
2.4.21. in the event of an air raid alert, all persons at the Location must proceed to the nearest shelter. The Lessor bears no responsibility for any harm caused to the life and health of the Lessee in case of the Lessee ignoring an air raid alert;
2.4.22. the Lessor bears no responsibility for any harm caused to the life and health of the Lessee related to the specific location of the Location, as well as other circumstances beyond the Lessor's control;
2.4.23. street shoes are prohibited at the Location. Shoes must be removed immediately upon entering the Dome. Disposable slippers are provided for guests' convenience;
2.4.24. moving any large furniture within the Dome is strictly prohibited;
2.4.25. moving any small decor items within the Dome is permitted only with the Administrator's approval;
2.4.26. any type of filming containing pornographic content or aimed at creating pornographic materials is prohibited. In case of violation of this prohibition, the Lessee bears responsibility in accordance with applicable law and undertakes to compensate for all possible damages and reputational losses caused to the Lessor;
2.4.27. if you do not want photos or videos from your event to be published on the website or our social networks, please let us know in any convenient way;
2.4.28. two cats permanently reside on the territory of the Location. If you or any of your guests have allergies or sensitivity to animals, please notify us in advance. We will do our best to ensure comfortable conditions for your stay.
3.1. Booking the Location for rental is carried out by any convenient method for the Lessee: on the website/social networks/by phone of the Lessor/in person, etc.
3.2. The rental cost of the Location depends on the Lessee's chosen option for using the Location, as defined on the website: https://cloudrooftop.com. The rental cost does not include bank and/or payment system commissions charged when making a payment.
3.3. The Location is considered booked after the Lessee makes a prepayment of 50% of the total cost of the chosen Location usage option. The booking prepayment for the Location is non-refundable under any circumstances.
3.4. By making the prepayment, the Lessee is automatically considered to have read the text of this Offer and accepts all provisions defined therein. By taking such actions, the Lessee also acknowledges that in accordance with Ukrainian legislation, acceptance of this Offer means the conclusion of an agreement between the Provider and the User.
3.5. The second part of the payment is made by the Lessee on the eve of the date. A paid booking is non-cancellable. The booking payment is non-refundable.
3.6. The chosen booking date and time can be rescheduled only once, no later than 48 hours before the booked date and time.
3.7. If the Lessee, after confirming the booking of the rental object, does not use the rental on the specified day and time, the rental prepayment is non-refundable and is credited as a penalty for the Lessee's failure to comply with the terms of this Agreement. In such case, the booking of the rental object is cancelled.
3.8. The paid rental fee is non-cancellable and non-refundable to the Lessee.
3.11. The amount of rental fee is not reduced due to late arrival or early termination of use of the rental object.
3.12. If necessary, the Lessee may extend the rental period if it is possible and the rental object is not booked by another Lessee for the given period. The minimum extension period is 30 minutes.
3.13. In the event of force majeure circumstances that make it impossible or significantly difficult to provide the service, persons who have paid for the stay at the Location may be offered to change the date and/or time of their stay at the Location.
4.1. In case of violation of obligations under this Offer, the Parties bear responsibility in accordance with the current legislation of Ukraine.
4.2. In case of violation by the Lessee of the obligations provided for in Section 2 of this Offer, the Lessee shall compensate the Lessor for the cost of damage caused to the Location and/or individual objects that are part of the Location and/or the building on the roof of which the Location is situated, in an amount corresponding to the damage caused and confirmed by the Lessor in any convenient manner.
4.3. The Lessor is not responsible for early termination of Location use by the Lessee of their own free will. In such case, funds paid by the Lessee to the Lessor are not refunded.
5.1. This Offer is written in Ukrainian and is governed by Ukrainian law.
5.2. All disputes that may arise in connection with this Offer will be resolved by a competent court in Ukraine.
5.3. In case of violation of the terms of this Offer, the Lessee and the Lessor bear responsibility in accordance with the provisions of this Offer and/or the legislation of Ukraine in force at the time of the violation.
6.1. The current version of the Offer is posted at: https://cloudrooftop.com and is available for review by all Lessees and other persons who want to rent the Location.
6.2. The Lessor may change the content of this Offer unilaterally. The new version of the Offer comes into force from the moment of its publication.
